The undermentioned terms and conditions (“Terms”) shall apply to access / use of the website “www.stratasmreit.com” owned by Strata Capital Management Private Limited (“Site”), and to all visual representations, illustrations, photographs, images, pictures, graphic representations, scale models, text, names, references, data, information and other Material(s) and services {collectively “Content(s)/Material(s)”} presented/contained in the Site. All references to the term “Site” hereunder shall also include the Contents/Materials. The Site and its Content(s) is/are provided by Strata Capital Management Private Limited (“Strata Capital”) for general information and reference only. The Content(s) is/are intended to portray only artistic impressions of the buildings/amenities and cannot be regarded as statement/s and/or representation/s of fact. The Site may contain links to third party sites not owned by Strata Capital which will be subject to their respective separate terms and conditions and policies.  

In addition to the foregoing, any person/entity logging onto/accessing/ navigating/using the Site or its Contents, you agree to be bound by these Terms, privacy policy and all applicable laws and regulations. You agree that you are responsible for compliance with any applicable laws pertaining to your use or access to the Site. If you do not agree with any of these Terms, you may stop your use or access of the Site. References of terms such as “you” and “your” in these Terms shall mean the user(s) who access and/or use the Site and terms such as “us” , “we” , and “our” shall mean Strata Capital.

2. Notwithstanding anything contained in this Site and/or its Content(s)

It is clarified, understood and agreed that Strata Capital, through its Site, does not intend to constitute/make any assurance, claim, offer, inducement, invitation, proposal, representation and/or contract of any nature for any purpose whatsoever. All transaction/s shall be governed only by the terms of the appropriate agreement entered into between the parties and no details mentioned on the Site shall govern the transaction/s. Under no circumstances may information contained on the Site be treated as any form of legal, investment, tax or other advice.

The Site is owned, administered, and monitored by Strata Capital, bearing CIN U65100KA2021PTC152603 and its registered office at No. 6/1-1, Museum Road, Mahatma Gandhi Road, Richmond Town, Bangalore, Karnataka, 560001. Subject to the compliance with the Terms and payment of fees (if and as applicable), Strata Capital grants you a non-transferable, non-exclusive, license to access and/or use the Site for your personal, non-commercial use. 

However, you shall not: 

1. Copy, distribute, display, download, reproduce, modify, repost, transmit or use any part of the Site without the prior written consent of Strata Capital; 
2. Use the Material(s) for any commercial purpose, or for any public display (commercial or non-commercial); 
3. Attempt to decompile or reverse engineer any software contained on the Site; 
4. Remove any copyright or other proprietary notations from any Material(s) on the Site. 

Any such action may constitute a violation of applicable laws. Your right to access the Site shall automatically terminate if you violate any of these restrictions and may also be terminated by Strata Capital at any time.

   2. Strata Capital hereby expressly disclaims any legal liabilities with respect to mistakes, omissions, inaccuracies and errors in the Site. The access and/ or use of this Site and/or any of its Content(s) and/or information contained in the Site are at your sole option and risk. Under no circumstances shall Strata Capital or any of its directors, agents, officers, employees, contractors, representatives, consultants or authorized persons or any of them, or their respective successors or assigns, be liable for any losses, damages, injuries, costs and expenses whatsoever (whether direct, indirect, consequential, incidental, special or economic, including loss of profits) whatsoever suffered or incurred by any person/User/s, due to:

1. any access or use, and/or inability to access or use, the Site and/or its Material(s) and/or its links / hyperlinks.

Such use creates a false or misleading statement or impression as to the positions, statements or actions of Strata Capital. No hyperlinking of this Site to any other website or the mirroring or reproduction/distribution/transmission of any Content/s on this Site on any other website or the use of any Material/Content(s) or information, etc. therein for any public or commercial purpose is permitted without the prior written consent of Strata Capital, which consent may be granted or refused at Strata Capital’s sole discretion and may be subject to terms and conditions imposed by Strata Capital. Facility to print an article or portion of text or Material on the Site through Computer/electronic device does not amount to prior written consent.

In no event shall Strata Capital be liable for any damages (including, without limitation to damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the Material(s) on the Site, even if Strata Capital or an authorised representative of Strata Capital has been notified of the possibility of such damage. Strata Capital shall not be in any way liable to you for any damages that may be caused to any computer, software, or other equipment on account of any download of the contents of the Site. Strata Capital shall have the right to be indemnified against all suits, actions, costs, and damages that may arise on account of the misuse or misrepresentation of the Contents/ the Site by you.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any dispute arising out of these Terms shall be referred to arbitration under the Arbitration and Conciliation Act, 1996 by a mutually appointed sole arbitrator. The seat and venue of the arbitration shall be Bengaluru, India and the proceedings shall be in English. Subject to the foregoing, all disputes under these Terms shall be subject the exclusive jurisdiction of the courts in Bengaluru, India.

13. Confidentiality

Strata Capital agrees to handle all information provided by you with utmost care and confidentiality in accordance with applicable regulations and prescribed industry standards. Similarly, you agree to treat all information provided to you by Strata Capital as confidential and shall not disclose it to any third party without prior written consent from Strata Capital. However, if required by an appropriate government authority or by applicable law, Strata Capital may have to disclose your confidential information without prior notice.

14. Intellectual Property

All Material(s) on the Site (as well as the organization and layout of the Site) are owned by and subject to the intellectual property rights (copyright, trademarks, etc.) of Strata Capital & its group companies and shall not be accessed, downloaded or printed only for your commercial use of any nature. Without the prior written permission of Strata Capital, you may not copy, distribute or transfer any Material(s) on the Site, in whole or in part.

2. That you may be sent information or contacted/ communicated through the e-mail addresses, phone numbers and postal addresses provided by you on the Site. If you do not desire to receive communication from, Strata Capital you must give clear written instructions for the same.
